You agree to indemnify and hold harmless Right Lead AI from any claims arising from your violation of this representation, including claims from individuals whose data you have uploaded without proper authorization or consent.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. RIGHT LEAD AI MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE OPERATION OF THE SERVICE OR THE INFORMATION, CONTENT, MATERIALS, OR PRODUCTS INCLUDED ON THE SERVICE. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, RIGHT LEAD AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
IN NO EVENT SHALL RIGHT LEAD AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, OR USE, INCURRED BY YOU OR ANY THIRD PARTY, EVEN IF RIGHT LEAD AI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
RIGHT LEAD AI'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO RIGHT LEAD AI IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR IF NO PAYMENT HAS BEEN MADE, ONE HUNDRED DOLLARS ($100).
While Right Lead AI employs advanced AI technology and best practices in lead reactivation, we do not guarantee any specific results, conversion rates, or revenue generation. Results vary based on numerous factors including data quality, industry, market conditions, and implementation. Past performance does not guarantee future results. You acknowledge that lead reactivation is not a guaranteed revenue source and that business outcomes depend on multiple variables beyond Right Lead AI's control.
Right Lead AI does not warrant that the Service will be uninterrupted or error-free. We shall not be liable for any damages resulting from the unavailability of the Service, including but not limited to lost revenue, lost business opportunity, or lost data. While we strive to maintain high availability, we do not guarantee 100% uptime.
All content, features, and functionality of the Service, including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof, are owned by Right Lead AI, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, and other intellectual property laws.
You retain all rights to any data, leads, or content you upload to the Service ("Your Content"). However, by uploading Your Content to the Service, you grant Right Lead AI a worldwide, non-exclusive, royalty-free, sublicensable license to use, copy, modify, and display Your Content solely for the purpose of providing the Service to you.
